When the author initially went public with this web site, this disclosure was made:
"The author of this web site has made every effort to not disclose the name of the builder. The builder has already profited greatly and the builder does not need any encouragement to further profiteer with a libel lawsuit.
Please do not ask for the name of the builder. We will not provide that information."
However, in order for there to be libel, the statements made MUST BE UNTRUE. To the best of the author's knowledge and abilities, all statements made in this web site are truthful and documented elsewhere or in this web site (e.g., see the tabs: Better Business Bureau, Check Out the Court House, Warranty, which links to the Maine Manufactured Housing Board's web site, and the images of the foundation damage). Unfortunately the truth doesn't prevent any individual from filing a lawsuit as a strategy to make a plaintiff capitulate. Some people so fear lawyers and costly lawsuits that they will not stand up for what it right. See: Check Out The Court House Not surprisingly the builder has already so threatened the author.
Additionally, the Maine Manufactured Housing Board v. builder recently published the Consent Decree, which identifies the builder. Consequently, the author is legally justified in linked to that Consent Decree, as it is a Maine State document that exist in the public domain and is intended as public information about the Board's licensees.
According to its web site, the Purpose of the Maine Manufactured Housing Board is:
"To ensure that manufactured housing is safe from hazardous defects,
provide uniform performance standards for construction and
installation of manufactured housing, and provide a safe and sanitary
environment for occupants residing in mobile home parks.
The primary responsibilities of the board are to examine and license
qualified applicants, to promulgate rules defining the qualifications and
professional standards of manufacturers, dealers and installers of
manufactured housing, to investigate complaints against its licensees,
and to take appropriate disciplinary action against noncompliance with
its statute and rules."
The author is using his First Amendment Right to Free Speech to chronicle his experiences in the World Wide Web public forum. The author's intent is "tell his story" only. If doing so helps other people avoid the missteps the author made then that too will have served a useful purpose. Unfortunately for the author, the reality and the truth of the matter is that the builder is an integral and important part of that story.
