This is the wording of the contract that relates to the completion time.
It states:
"The estimated date when the work will be substantially completed is approximately 6-8 months from the start of the excavation and delivery of the house from the modular home company."
As the project progressed, we found that what we thought was reasonable contract wording, was stacking the contract against us and in favor of the builder in terms of costs and completion. The contract really benefited only the builder.
Substantially and approximately are more "wiggle words."
Try as we might, we never got a firm completion date even as the project neared completion. There was always an excuse... weather, etc., even the owners getting in the way of progress.
In our next contract we will insist on a clause, which contains no wiggle words and that specifies a completion time. This clause will also include the consequences if the specified completion time is not met.
